These Terms and Conditions govern your use of the Thomas Woodberrys website (the "Site") and your relationship with Thomas Woodberrys ,whose registered office address is at Thomas Woodberrys Wines, 3 Middle Street Mews, Middle Street, The Latin Quarter, Galway City, Ireland (the "Company", "we" or "us"). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the Site. It is against the law to sell or supply wine to persons under 18 years of age in the Republic of Ireland. Our acceptance of any order is based on the purchaser being at least 18 years old. Orders may be filled and placed by clicking the 'confirm order' button. In doing this you are making a commitment to buy from us within our terms. We will respond with an email confirmation of the order once your payment has been received. This confirmation email will be sent by us and may end up in your junk folder. If it does please make sure our domain is white-listed so that you receive any other communications about your order as quickly as possible.
Payment will be accepted by debit card (Laser, Delta, Maestro, Electron), credit card (Visa, MasterCard), or charge card (American Express). All credit and charge card transactions are subject to validation checks and authorisation by the card issuer. We may need to contact you again to verify details before we deliver, and will not be held responsible for any delay so caused.
At the point at which your payment is received by us a legally binding contract will exist between you and the Company, but we reserve the right to refuse or amend any order up to the point of dispatch (for wines for delivery), and you have the right of cancellation as set out below. If we have to amend your order we will always contact you before proceeding with the sale. In registering on the site or placing any order for alcohol you confirm that you are over 18. No contract shall exist between us and anyone under 18 who attempts to order or to take delivery of alcohol. If our drivers are in any doubt about this they are instructed not to leave the goods and the sale will be cancelled.
Thomas Woodberrys does its utmost to ensure that all wines offered on the website are currently available, but availability maybe limited, particularly in the case of the small producers. All products are offered subject to availability.
5 Pricing and Discounts
Prices are given per bottle (75cl for wine) or as otherwise listed. Our general lists display the standard bottle price followed by a discounted price if the wine is on promotion.
Discounted prices apply to a minimum quantity of one case of wine (twelve bottles), which may be mixed in any combination across our range, subject to collection or a single delivery address.
Unless otherwise stated in respect of particular offers, prices include duty and VAT and are quoted in Euros €.
Whilst we make every effort to ensure availability of wines offered and correct pricing, mistakes can occur. If a product is accidentally offered at an incorrect price, we reserve the right to refuse to supply at the incorrect price and will contact you to see if you wish to proceed with the sale at the correct price.

Correct Delivery Details
It is the responsibility of the purchaser to provide correct and accurate delivery address details. We cannot be held responsible for the misdirection, delay or loss of an order in the event that an incorrect delivery address has been provided. While we will do everything we can to assist, any losses, costs of recovery and/or costs of resending the order will be borne by the purchaser. When you purchase wine as a gift from us the same criteria outlined in previous lines apply to the receiver, namely that the delivery name, address and contact number are correct and accurate. The name and billing address of the purchaser will be included with the wine for the receiver, unless you specifically request for this information to be withheld.
You can return all your order up to 14 days after you have received it, however you will be responsible for the safe return to us and all goods must be undamaged and in a resalable condition. You can also return the order in person to us at our shop on Middles Street in Gawlay. A refund as appropriate will be provided within 7 days of receipt by us.
Should you wish to cancel your order, you can cancel right up to the point of dispatch and we will refund your order in full within 7 days.
If you wish to cancel once the order has been dispatcehd but before delivery, you should refuse delivery and ask the courier to return to sender citing cancellation of order. In this event we will refund your order within 7 days of receipt of the order back to our warehouse, up to a maximum of 14 days from the date of our original dispatch.
You can also cancel and return your order up to 14 days after you have received it, however you will be responsible for the safe return to us and all goods must be undamaged and in a resalable condition. A refund as appropriate will be provided within 7 days of receipt by us.
Any claims for short delivery or breakage or any other defect or deficiency must be notified to us within 24 hours of delivery.
You will be deemed to have accepted the goods as delivered and in fulfilment of your order unless we hear from you within 48 hours of collection or delivery, and you will not be entitled to reject them thereafter except as set out below.
9 Faults & Brackages
Cork Taint Pledge
Very occasionally, a wine may suffer from cork taint, the unpleasant effects of a faulty closure. Cork taint is more common in bottles with a traditional cork closure, and is recognisable by a damp wood or rotten cardboard smell. It's often quite pungent, and immediately detectable when opening a bottle for the first time. Should this occur we will gladly replace the wine in question for a new bottle of the same or if that wine is unavailable a similar wine of the same price.
Sometimes glass bottles break, despite our very best efforts. As soon as we’re made aware of this, we will dispatch your order again. You should never accept a parcel from us that appears damaged, in the unlikely event that this happens you can refuse receipt and ask the courier to return to sender.

These Terms and Conditions are governed by and construed in accordance with the laws of Ireland and any disputes will be resolved only by Irish courts.
